In its decision, the Supreme Court denied an appeal of the Indian's Tea Board, which claimed that the mark DARJEELING is associated with India's famous tea products under that name. The court held that since the appellant does not own registered trademarks in Israel, and the goods (women underwear and tea products) are remote, there is no infringement of the appellant's rights by registering the mark for women underwear.
